Our tool helps you identify any defects in the property you’ve purchased that could make it unliveable according to government guidelines.

The tool assigns a score to each condition issue based on severity, adding them up to give a total score. A score above 100 suggests the property is unlivable, and above 300 is a strong case.
If your property is unliveable, it cannot be classified as ‘residential’ for stamp duty purposes. Instead, it can be classified as ‘non-residential,’ and you can pay commercial stamp duty rates, which are usually lower than residential rates. Our stamp duty calculator can show you the difference in rates, and help you determine how much you might save.
“Uninhabitable” and “unlivable”
The terms “uninhabitable” and “unlivable” are often used interchangeably and can mean similar things, but there is a subtle difference in their meanings.
“Uninhabitable” usually refers to a property that is not fit for human habitation due to its condition, such as a severe lack of basic utilities or structural damage. This can be an objective assessment based on local government codes and regulations.
On the other hand, “unlivable” is a more subjective term that can refer to a property that is not comfortable or suitable for living in, even if it meets basic standards for habitability. For example, a property might be unlivable due to noise pollution or other environmental factors, despite being structurally sound and meeting local codes.
Overall, the key difference between the two terms is that “uninhabitable” is a legal and objective term used to define a property that fails to meet minimum standards for human habitation, while “unlivable” is a more subjective term that can refer to any property that is not comfortable or suitable for living in, regardless of its objective condition.

Technically, what are you as a business?

How long is it before HMRC may not contest a stamp duty reclaim?
To avoid issues with HMRC, it’s important to keep the stamp duty savings for 9 months after reclaiming. While it’s possible HMRC may challenge the decision beyond the 9 month deadline, it’s unlikely based on past cases.
How can I calculate the amount of stamp duty I overpaid?
To calculate the amount of stamp duty you overpaid, you need to compare the amount of stamp duty you paid at the time of the property transaction to the correct amount you should have paid based on the property price and the relevant reliefs and exemptions. How long does it take to get a stamp duty refund?
The time it takes to receive a stamp duty refund varies and depends on several factors, including the complexity of the case, the workload of HMRC, and the availability of the required documentation and evidence. On average, it can take anywhere from 5 weeks to 3 months to process a stamp duty refund claim and receive the refund payment.
Can I get a refund if I overpaid stamp duty?
Yes, you may be eligible for a refund if you overpaid stamp duty. However, to determine if you are eligible for a refund, you will need to assess the specific circumstances of your case, including the property price, type, and purchase method. To reclaim the overpaid stamp duty, you will need to submit a detailed report to HM Revenue & Customs (HMRC) explaining the reasons for the overpayment and any reliefs or exceptions that were missed.

Even if you have completed the property transaction, it is still possible to get a refund for overpaid stamp duty. In general, all house purchases made after 8th February 2017 may be eligible for a refund if they meet the criteria for being classified as ‘non-residential’.
